Please read these terms carefully before utilizing NearBaazar. By accessing our discovery directory, searching retail inventories, or requesting stock reservations, you agree to these terms.
1. Safe Harbor Intermediary Declaration (IT Act 2000 §79)
NearBaazar operates strictly as a digital directory and price discovery platform under Section 79 of the Information Technology Act, 2000. NearBaazar is not an online retailer, seller, re-seller, warehouse operator, or delivery service.
Important Operational Clarifications:
- Zero Inventory Custody: All listed items are owned, stocked, and sold solely by independent verified neighborhood retailers.
- Direct Offline Settlement: All transactions, financial payments, invoicing, and collections occur directly between customer and merchant at the retail store.
- No Online Payments: NearBaazar does not solicit, process, or hold consumer funds for product purchases.
2. 1-Tap 6-Hour Stock Reservations
When you reserve an item on NearBaazar, a priority hold request is transmitted to the merchant for physical collection within 6 hours. Reservations represent a good-faith customer hold and are not binding purchase contracts until confirmed and inspected in person at the retail counter.
3. Retailer Pricing & Legal Metrology Compliance
Participating merchants are solely responsible for compliance with the Legal Metrology Act, 2009, and the Consumer Protection (E-Commerce) Rules, 2020. Merchants warrant that prices displayed on the platform do not exceed statutory Maximum Retail Price (MRP) and that listed inventory statuses reflect genuine store availability.
4. Dispute Resolution & Jurisdiction
These terms are governed by the laws of India. Any legal dispute, arbitration, or statutory claim arising from or related to the usage of NearBaazar shall be subject to the exclusive jurisdiction of the competent courts in Pathankot, Punjab, India.
